The organiser of the “Free Battery” promotion is FLEX Elektrowerkzeuge GmbH, Bahnhofstraße 15, 71711 Steinheim, Germany (“FLEX”).

The promotion is being held in Germany, Austria, Belgium, the Netherlands, Luxembourg, France, Italy, the Czech Republic, Slovakia and the United Kingdom ("participating countries").

The promotion will run from 01.04.2024 (00.00) up until and including 31.08.2024 (24:00) (“promotion”). This means that the purchase of a promotional product entitling the customer to participate in the promotion must have been made within the promotion period as shown on the invoice. Registration for the "Free Battery" promotion must be done within 30 days of the date of purchase. Registrations received after this deadline will no longer be accepted.

During the promotion period from 01/04/2024 to 31/08/2024, purchase a new FLEX cordless tool from the 18V range worth at least £ 259 (FLEX recommended retail price plus VAT) per tool or alternatively a FLEX garden tool from the 18V range (a "promotional product” in both cases) from a retailer participating in the "Free Battery" promotion (in-store or online) in one of the above-mentioned countries.

Register the promotional product within 30 days of the purchase date at https://warranty.flex-tools.com for the three-year warranty. When registering, enter your first and last name, your address as the delivery address, the serial number of the unit you have purchased, the name of your authorised dealer and the invoice number of your purchase receipt. Register for the FLEX Newsletter and then click on “Register”.

While stocks last, you will receive one of 5000 FLEX X Lithium Power 18 Volt, 5 Ah batteries (AP18.0/5.0) ("Free Battery") following full registration for the FLEX three-year warranty during the promotion period.

Each participant can acquire a maximum of five free batteries as part of the promotion. The requirement for receiving more than one free batteries is the purchase of a corresponding number of promotional products (example: five promotional products purchased entitle you to five free batteries). Multiple participation is possible via one registration for several promotional units or several registrations.

Only end customers who are natural persons aged 18 or over at the time of participation and who have a permanent place of business or residence and an address in one of the participating countries as well as a valid e-mail address are eligible to participate. Employees of FLEX and of authorised FLEX dealers and their relatives are not eligible to participate.

FLEX has the right to disqualify participants who deliberately provide false or incomplete information, manipulate or attempt to manipulate the participation process and/or who culpably violate the participation rules and/or otherwise attempt to influence participation in an unfair and/or dishonest manner, and to exclude them from future participation in such promotions.

Entitlement to a free battery only exists while stocks last and is conditional upon a validly-concluded contract for the purchase of a promotional product. If participation is approved, delivery of the free batteries can take up to six weeks and they will only be shipped to the country in which the corresponding promotional product was purchased. FLEX reserves the right to cancel the voluntary promotion in whole or in part. Unless otherwise stated in these Participation Terms including the following provisions, FLEX shall be liable in accordance with the statutory provisions in the event of a breach of contractual and non-contractual obligations. In the event of simple negligence, FLEX shall be liable, subject to a milder standard of liability in accordance with statutory provisions (e.g. for diligence in its own affairs), only

1. for damages resulting from death, injury or damage to health,
2. for damages arising from the not insignificant breach of a material contractual obligation (obligation the fulfilment of which is essential for the proper execution of the contract and on compliance with which the contractual partner recurrently relies and may rely); in this case, however, our liability shall be limited to compensation for the foreseeable, typically-occurring damage.

The limitations of liability resulting from this shall also apply in the event of breaches of duty by or in favour of persons for whose fault we are responsible in accordance with statutory provisions
